1. Agreement to Terms

By accessing or using the services of MiftahCoding ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services

MiftahCoding provides software development, web development, app development, and related IT services. The specific scope, deliverables, and timeline for each project will be outlined in a separate project agreement or proposal.

3. Client Responsibilities

As a client, you agree to:

Provide accurate and complete information as required
Respond to our communications in a timely manner
Provide necessary access, content, and approvals for the project
Make payments according to the agreed schedule
Review deliverables and provide feedback within specified timeframes

4. Intellectual Property

4.1 Client Materials

You retain all ownership rights to materials you provide, including logos, content, and data. You grant us a license to use these materials solely for completing your project.

4.2 Deliverables

Upon full payment, you will own the custom code and designs created specifically for your project. We retain the right to use generic components, libraries, and tools in other projects.

4.3 Portfolio Rights

Unless otherwise agreed, we reserve the right to display completed projects in our portfolio and marketing materials.

5. Payment Terms

Payment terms and schedules will be specified in the project proposal
A deposit may be required before work begins
Payments are due as per the agreed milestone schedule
Late payments may result in project delays or suspension
All fees are non-refundable unless otherwise stated

6. Project Timeline

Project timelines are estimates based on the agreed scope. Delays may occur due to factors including but not limited to:

Delayed feedback or approvals from the client
Scope changes or additional requirements
Technical challenges or unforeseen circumstances

7. Changes and Revisions

The number of revisions included in the project will be specified in the proposal. Additional revisions or scope changes may incur extra costs and affect the timeline.

8. Warranties and Disclaimers

We warrant that our work will be performed in a professional manner consistent with industry standards. However:

We do not guarantee specific business results or outcomes
Third-party services and integrations are subject to their own terms
We are not liable for issues arising from client-provided materials

9. Limitation of Liability

To the maximum extent permitted by law, MiftahCoding shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services. Our total liability shall not exceed the total fees paid for the specific project.

10. Termination

Either party may terminate the agreement with written notice. Upon termination:

The client is responsible for payment for work completed
We will deliver any completed work upon receipt of payment
Deposits are generally non-refundable

11. Confidentiality

Both parties agree to keep confidential any proprietary information shared during the project. This obligation survives the termination of the agreement.

12. Governing Law

These terms shall be governed by and construed in accordance with the laws of Bangladesh. Any disputes shall be resolved through negotiation or, if necessary, through the courts of Rajshahi, Bangladesh.

13. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective upon posting to our website. Continued use of our services constitutes acceptance of the modified terms.
